OVERVIEW
About NIL and Disclosures
Since July 1, 2021 collegiate athletes were given the to right to be compensated while participating at any level of collegiate sports without penalty, so long as the activities the athlete engages in are deemed permissible by the their school.
A disclosure is a documentation collegiate athletes need to submit to their respective schools before engaging in any active where said athlete is compensated for any deal requiring the use of their name, image, or likeness (NIL).
Problem
College athletes entering NIL deals often complain about the current process of having to submit a disclosure prior to entering an NIL deal with a company. College athletes often sight confusion and the time it takes to submit disclosures as the key reasons why they botch submitting deal disclosures to their school’s compliance team. When a disclosure is submitted incorrectly it creates a headache for the athlete and the school’s compliance team but most importantly, it put the athlete NCAA eligibility in jeopardy.
goal
Improve the disclosure process in order to reduce athlete errors, and disclosure abandonment.
objectives
- Reduce the number of steps to complete a disclosure.
- Make it easier for athletes to provide key details for a disclosure.
research
I interviewed a dozen college athletes who were familiar with the current disclosure process in addition to serval college compliance teams.
Key Findings
College Athletes
1. Athletes often admitted didn’t report gifts they received as part of NIL deal.
2. Athlete’s deals were often more complex than cash compensation and gifts. They were also given discounts on products or services and engaged in profit-sharing and other variable compensation types.
Compliance Team
1. School compliance teams were often under pressure from Athletics Directors get to get as much information about athlete deals in order to not break any NCAA rules that could result in an athlete being suspended.
2. A big issue for schools were athlete misreporting key information. Athletes often misspelled brand names or representatives they were working with, especially if it was their first deal with either party.
solutions
Rethink the user flow
To improve the process, changes needed to be made to the overall process. The first change needed was to start the process by selecting who is paying the athlete instead of having the activity come first.
Changing this order opened the possibility for users to add multiple activities in a single disclosure, reducing the number of disclosures they needed to submit.
Reduce user error opportunities
Database Search
Giving athletes the ability to search our platform’s database of businesses and athlete rep accounts will help to reduce misspellings and inaccurate disclosure info.
Auto Total Compensation Calculation
This flexible compensation feature encompasses the various types of compensation athlete’s receive for deals and can calculate the total compensation for an activity.
One to many and recurring activities
Adding functionality that will allow users to have multiple activities on a single disclosure. This will help compliance teams better manage disclosures and make the process simpler for athletes.
Adding functionality that gives athletes the ability to set up recurring disclosures eliminates the redundancy and confusion of the original disclosure process.
